Types of Assault Charges in Michigan
1. Simple Assault & Battery
Penalty: Up to 93 days in jail
Often a misdemeanor
Common in bar fights, heated arguments, or minor altercations
2. Domestic Assault
Penalty: Also up to 93 days in jail (for first-time offenses)
Same as simple assault—but involves a domestic relationship (spouse, partner, roommate, etc.)
3. Aggravated Assault
Involves serious injury requiring medical attention or causing disfigurement
Penalty: Up to 1 year in jail
4. Felonious Assault (Assault with a Dangerous Weapon)
No injury required—only the threat using a weapon
Weapon does not have to be loaded (i.e., an unloaded gun can still qualify)
Penalty: Up to 4 years in prison
5. Assault with Intent to Do Great Bodily Harm Less Than Murder
A more serious felony involving intent to seriously injure
Includes strangulation or suffocation
Penalty: Up to 10 years in prison
6. Assault with Intent to Murder
Attempting to kill someone, even if unsuccessful
Example: Firing a gun and missing
Penalty: Up to life in prison
